Personal data collected on this website is processed in accordance with the Data Protection (Bailiwick of Guernsey) Law, 2017 (“DP Law”)

Where does the personal information we collect come from?

We may collect your personal information in a number of ways, including when you enquire about our services, access our services, enquire regarding becoming a volunteer or a member of staff or a supervisor, request training, take part in events or when you make a donation. We may also receive your personal data to manage, facilitate and keep records of financial transactions, including data from third parties such as Just Giving or Giving.gg, if you chose to donate to us through these providers.

We may obtain sensitive data

We may collect data that is defined in the DP Law as “sensitive data” e.g., where we obtain demographic data or health information. We only hold this data for specific purposes and with your consent.

Personal information

We collect the following personal information:

Your name, address, phone numbers, email addresses and, in the case of online counselling your Skype/Zoom or other ID.

We also maintain details of your enquiry, notes on assessment and counselling sessions you attend, so that we can provide our service to you.

How we use the information we collect

Where relevant we use the personal information you have provided to us for one or more of the following purposes:

  • to provide you with information;

  • to provide a safe and consistent service;

  • to communicate with you (such communications may be made by telephone, by post, by electronic means (such as email or SMS) depending on the consent you have provided to us);

  • to accept and process donations;

  • to provide advice, subject to your specific consent, to healthcare professionals;

  • to provide you with news and updates, details of events, resource and appeals;

  • for administrative purposes; and

  • we may ask you for your consent to retain your information, so that we can contact you in the future.

Who your information may be shared with

No information is transmitted to third parties without your express consent except as set out below:

Exceptions are:

Where you give consent for confidence to be broken, we will only speak to the specific person named by you, e.g., your general practitioner (GP) or other health professional.

Where we are required by law to disclose information or where the information ‘is of such gravity that confidentiality cannot be maintained’ e.g., in cases of fraud, crime, terrorism.

Where we believe there is a case of actual or potential serious physical harm to yourself or others.

Keeping your information secure

We will use technological and organisational measures to keep your information secure. These measures may include the following:

User account access on computers is controlled by individual usernames and passwords.

Physical notes are handled securely when in use and when not in use are stored under lock and key.

However, while we will use all reasonable efforts to secure your personal data, the use of email is not entirely secure and for this reason we cannot guarantee the security or integrity of any personal data that may be transferred from or to you via the internet. Similarly, we cannot guarantee the security or integrity of any telephone or video counselling connections. Security of the premises is considered appropriate and all members of staff and volunteers are aware of the need to maintain security of personal information, in whatever form, at all times. This obligation to you does not cease. If you have any particular concerns about your information, please contact us using the details above.

What Rights do you have?

The DP Law sets out the rights you have over your personal date. We have summarised the rights you have below:

To request a copy of your information

You can request a copy of the information which we hold on you (this is known as a subject access request).

To verify you information and correct any mistakes in your information

You can request us to correct any mistakes in the information we hold on you.

To withdraw consent at any time

You can withdraw your consent for us to process your information at any time.

We will retain personal data for different periods of time depending on your relationship with us. If you use our counselling services you will be asked to sign an agreement with us confirming (i) that we may process and hold your personal data collected by us and (ii) a period of time for which such data will be retained.

To restrict the processing of your personal data

You have the right under certain circumstances to restrict the processing of your personal data. In this case we will not process your personal data for the restricted purpose but may continue to store it.

To have your personal data deleted or removed

You have the right under certain circumstances to require us to delete your personal data from our records.

To receive your data and have it transferred to another controller.

If we are processing your personal data (i) based on your consent, or in order to enter into a contract with you, and (ii) the processing is being undertaken by automatic means, you may ask us to provide it to you or another service provider. However, we are a charitable organisation and most of the personal data we process is not processed by automatic means.

To object to the processing of your personal data

If we are processing your personal data based on public interest, you have a right to object to our use of your personal data by providing grounds to justify your objection.

If we are processing your personal data for direct marketing purposes and you wish to object, we will stop processing for these purposes as soon as reasonably practicable.
